On 24th April 2026, the High Court of Tanzania granted an application for leave to a private person to prosecute in a criminal case. See David Garanx and Others Versus Raphael Ernest Raphael Criminal Appeal No. 000029647 of 2025.
Through this milestone judgment, it is now a settled principle that Section 100 (1) of Criminal Procedure Act R.E of 2023 is an alternative route to justice where the DPP has for one reason or the other declined to prosecute.
